Purpose

To provide a safe and healthy environment and to support Cambrian College’s (the “College”) overall strategy for health and wellness.

Application/ Scope

All Cambrian College employees, students, contractors and general public.

Definitions

Cannabis1: A dried preparation of the flowering tops or other parts of the cannabis sativa plant or a resinous extract of it (cannabis resin), used as a psychotropic drug, and often smoked.

Cambrian Property: Any land boundary owned and controlled, or leased, by the College, inclusive of buildings, learning places, public places, and workplaces.

College Vehicle: A Vehicle that is owned, leased or rented by Cambrian.

Electronic Smoking Device(s): Any product containing or delivering nicotine or any other substance intended for human consumption that can be used by a person in any manner for the purpose of inhaling vapour or aerosol from the product. The term includes any such device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-hookah, or vape pen, JUUL or under any other product name or descriptor.

Medical Cannabis: Cannabis, which is used by an individual for medicinal purposes pursuant to a prescription from a physician and approval from Health Canada.

Smoking: Inhaling, exhaling, burning or carrying any lighted or heated cigarette, cigar, pipe, or any other lighted or heated tobacco or plant product (smoke-producing product) intended for inhalation, including hookahs (water pipe/shisha) and cannabis, whether natural or synthetic, in any manner or in any form. Smoking also includes the use of an Electronic Smoking Device which creates an aerosol or vapor, in any manner or in any form, or the use of any oral smoking device.

Smudging: An Indigenous practice of burning certain plants such as sweet grass, sage, cedar and/or tobacco, in order to create a cleansing smoke, which is used to purify people, as well as ceremonial and ritual spaces and ceremonial tools and objects.

Vaping: Inhaling and exhaling the vapor or flavored steam containing nicotine or other drugs produced by an electronic device.

Vehicle: Any and all modes used for transporting people or goods, including but not limited to, car, truck, bus, golf cart, and utility vehicle.

Prohibited Products: includes cigarette, e‐cigarette, cigar, pipe, hookah or water pipe, all forms of smokeless tobacco and cannabis.

Policy Statements

  1. Smoking, Vaping and the use of Prohibited Products is not permitted on Cambrian Property, including in any Vehicle while on Cambrian Campus and in any College Vehicle whether on or off Cambrian Campus.
  2. Smudging is a permitted exception, as outlined in the Smoke-Free Ontario Act, 2017.
  3. Prohibited Products shall not be advertised or sold on campus.
  4. The College will consider requests to consume Medical Cannabis on a case by case basis in a manner that is consistent with its duty to accommodate under the Human Rights Code, 1990.
    1. Community members having legal authorization to possess Medical Cannabis must self-identify their requirement for accommodation with Security and/or the Manager, Equity, Human Rights and Accessibility.
  5. A person found to be in contravention to this Policy may be subject to sanctions under the Code of Conduct or employee disciplinary procedures. Such sanctions may be progressive, in the case of repeated violations.
  6. The College supports smoking cessation and engages in providing resources to its community members.

Responsibilities and Accountability

College staff are responsible for:

  • Be knowledgeable of this Policy and its requirements.

Administrators, Leasehold Tenants, Contracted Services are responsible for:

  • Ensure policy compliance on College property.
  • Ensure that this Policy is observed and appropriately address any concerns brought to their attention regarding violations.
